Since 2009, K.S.A. 58-3078a has required every contract for the sale of residential property to carry a radon notice — one that identifies radon as a Class-A carcinogen, recommends a radon test by a certified measurement technician before purchase, and states plainly: “Kansas law requires sellers to disclose any information known to the seller that shows elevated concentrations of radon gas in residential real property.”

So in every Topeka sale, two things are true by statute: the buyer is told, in the contract itself, to consider testing — and the seller must disclose any known elevated results. What Kansas Transaction Data Shows

The Kansas Radon Program has published what actually happens in Kansas sales: about 33% of homes sold get tested for radon during the transaction, and of those, about 30% test high — and get fixed with a mitigation system. Program analysis of one year’s sales estimated thousands more homes would have tested high but were simply never tested.
